Welcome to EmergentOS. These Terms of Service (“Terms”) govern your access to and use of the EmergentOS platform, website, and services provided by EmergentOS Inc. (“EmergentOS,” “we,” “us,” or “our”).
BY ACCESSING OR USING THE SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS.
1. Acceptance of Terms
By creating an account, accessing, or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
2. Eligibility
You must be at least 18 years old to use the Services.
3. Account Registration and Security
You agree to provide accurate information during registration and maintain the confidentiality of your account credentials. Given our zero-knowledge architecture, you are solely responsible for maintaining secure backups of your encryption keys. If you lose your encryption keys, we cannot recover your data.
4. Use of Services
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable license to access and use the Services for your personal or internal business purposes.
You agree not to: violate any laws, infringe upon others’ rights, upload harmful content, attempt unauthorized access, interfere with the Services, transmit malicious code, use automated systems without authorization, or impersonate others.
5. Subscription and Payment
We offer various subscription plans (Foundation $69/mo, Amplification $499/mo, Transformation $1,249/seat/mo, Sovereignty $100K+/year). Subscriptions renew automatically unless cancelled. We do not provide refunds for partial periods except as required by law.
6. Third-Party Integrations and Google API Services
The Services may integrate with third-party platforms, including Google API Services (such as Gmail, Google Calendar, and Google Drive). When you authorize EmergentOS to access your Google account:
EmergentOS’s use and transfer of information received from Google APIs to any other app will adhere to the Google API Services User Data Policy, including the Limited Use requirements.
You may revoke EmergentOS’s access to your Google account at any time through your Google Account settings (https://myaccount.google.com/permissions).
EmergentOS accesses only the Google data you explicitly authorize and uses it solely to provide the features you requested within the platform.
7. Content and Intellectual Property
You retain ownership of your content. The Services are owned by EmergentOS and protected by intellectual property laws.
8. Privacy and Data Protection
Our collection and use of your information are governed by our Privacy Policy, available at emergentos.ai/privacy.
9. Disclaimer of Warranties
THE SERVICES ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND.
10. Limitation of Liability
EMERGENTOS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.
11. Indemnification
You agree to indemnify EmergentOS from claims arising from your use of the Services, your content, or your violation of these Terms.
12. Termination
We may suspend or terminate your access at any time for any reason, including violation of these Terms.
13. Governing Law
These Terms shall be governed by the laws of the State of Delaware. Any disputes shall be resolved in Delaware courts.
